			<content:encoded><![CDATA[<p>BIRMINGHAM, Alabama (AP) – Hispanic students have started vanishing from Alabama public schools in the wake of a court ruling that upheld the state&#8217;s tough new law cracking down on illegal immigration.</p>
<p>Education officials say scores of immigrant families have withdrawn their children from classes or kept them home this week, afraid that sending the kids to school would draw attention from authorities.</p>
<p>There are no precise statewide numbers. But several districts with large immigrant enrollments — from small towns to large urban districts — reported a sudden exodus of children from Hispanic families, some of whom told officials they would leave the state to avoid trouble with the law, which requires schools to check students&#8217; immigration status.</p>

			<content:encoded><![CDATA[<p><strong>Treasury IG Report Found Number Increased Four Fold from Five Years Ago</strong></p>
<p>SALT LAKE CITY – U.S. Senator Orrin Hatch (R-Utah), Ranking Member of the Senate Finance Committee, announced today that he will be examining how the Internal Revenue Service (IRS) gave $4.2 billion in refundable tax credits last year to illegal aliens – four times the amount from five years ago.</p>
<p>The information was released today in a report issued by the Treasury Department’s Inspector General for Tax Administration. The Finance Committee has jurisdiction over all tax policy, the IRS and the Department of Treasury.</p>
<p>“The disconcerting findings in this report demand immediate attention and action from Congress and the Obama Administration,” said Hatch. “With our debt standing at over $14.5 trillion and counting, it’s outrageous that the IRS is handing out refundable tax credits, which are spending through the tax code, to those who aren’t even eligible to work in this country. I will be looking at this as soon as Congress returns next week.”</p>
<p>The report found that:</p>
<p>“Although the law prohibits aliens residing without authorization in the United States from receiving most Federal public benefits, an increasing number of these individuals are filing tax returns claiming the Additional Child Tax Credit (ACTC), a refundable tax credit intended for working families.”</p>
<p>$4.2 billion in refundable credits were paid to individuals not authorized to work in the United States in Processing Year 2010.</p>
<p>“[T]he payment of Federal funds through this tax benefit appears to provide an additional incentive for aliens to enter, reside, and work in the United States without authorization, which contradicts Federal law and policy to remove such incentives.”</p>

<p>Republicans on the House Administration Committee want to shore up voter registration rules in the wake of a Colorado study that found as many as 5,000 non-citizens in the state took part in last year’s election.</p>
<p>Rep. Gregg Harper (R-Miss.), the panel’s chairman, called the study “a disturbing wake-up call” that should cause every state to review its safeguards to prevent illegal voting.</p>
<p>“We simply cannot have an electoral system that allows thousands of non-citizens to violate the law and vote in our elections. We must do more to protect the integrity of our electoral processes,” Harper added.</p>

			<content:encoded><![CDATA[<p>IMPERSONATION OF FEDERAL EMPLOYEES</p>
<p>CARSON CITY, NV:   The Office of the Nevada Attorney General, in cooperation with State and Federal authorities, today arrested three people in connection with a nationwide immigration scam that entailed impersonating Federal employees of the U.S. Citizenship and Immigration Service (USCIS).</p>
<p>The criminal complaint alleges a company, Telestaffing, located at 610 Plumb Lane, Reno, deceived persons into believing they were employees of USCIS and were able to assist them in obtaining and completing immigration forms and filing them with USCIS.  The group used a fee schedule which was identical to the fees posted by USCIS.  Delays in the processing of customer immigration papers caused some to lose their legal status.</p>
<p>Charles Doucette, Deborah Stilson and Cybil Duran Berti have been arrested and charged with six counts of Obtaining Money Under False Pretenses in the Course of a Technological Crime, six counts of Conspiracy and two counts of Criminal Racketeering. </p>
<p>“These egregious actions by scammers who impersonate Federal employees and prey on innocent people who are trying to work within the system to achieve citizenship is particularly distressing,” said Attorney General Catherine Cortez Masto.</p>
<p>“The original reports that led to this investigation and today’s arrests were called in by concerned citizens to ICE’s toll-free tip line,” said John Budrewicz, acting resident agent in charge for U. S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations in Reno.  “As is so often the case, the people who ended up being victimized by these defendants were trying to do the right thing and abide by the law.  Instead, they ended up being duped.  This enforcement action should send a message about our collective resolve to seek justice for those who prey on the well intentioned and the vulnerable.”</p>
<p>Telestaffing, which was doing business under several names including Immigration Forms, Immigration Forms Processing Center, Immigration Forms And Services, Immigration Forms and Documents, USA-Helpline.Info, and Immigration Helpline, duplicated electronic checks for its services without authority, resulting in a double payment for the filing. Consumers who paid by money order or by other means found the defendants either refused to file the documents with USCIS or simply did nothing and kept the money.</p>
<p>The Office of the Nevada Attorney General received cooperation on this action from the Better Business Bureau of Northern Nevada, the Washoe County Sheriff’s Department, the City of Reno, the Reno Police Department, the Colorado Attorney General, the Missouri Attorney General, the U.S. Marshals Service, U.S. Immigration and Customs Enforcement’s Homeland Security Investigations, the Federal Trade Commission, and the United States Department of Justice, all who assisted in the investigation of this matter. </p>
<p>The filing of a criminal complaint or arrest is not a determination of guilt or innocence, but is a finding of probable cause by the Nevada Attorney General that a crime was committed. The defendants are presumed innocent until proven guilty. </p>

David Vitter (La.) and Rand Paul (Ky.) announced on Thursday their new push to deny birthright citizenship to the children of illegal immigrants via a congressional resolution, a legislative backdoor that they hope will prove easier than trying to amend the pertinent section of the U.S. Constitution.</p>
<p>The Supreme Court has consistently held that the Fourteenth Amendment grants automatic citizenship to those born on U.S. soil, but Vitter and Paul said Thursday that right should not extend to children of undocumented parents and that their resolution would close this &#8220;loophole.&#8221; Passing an amendment to the Constitution is near-impossible, so the senators are instead introducing a &#8220;resolution that would amend the Constitution,&#8221; according to a statement from the senators.</p>
<p>It&#8217;s incorrect to assume &#8220;the 14th Amendment confers birthright citizenship to the children of illegal aliens, either by its language or intent,&#8221; the statement said. &#8220;This resolution makes clear that under the 14th Amendment a person born in the United States to illegal aliens does not automatically gain citizenship.&#8221;</p>
<p>This is the primary argument the two Republicans will have to stand on. They&#8217;re walking a fine line between their broad ideology of strict adherence to the Constitution &#8212; Paul in particular has been a darling of the Tea Party &#8212; and their animus for undocumented immigration.</p>

			<content:encoded><![CDATA[<p> WASHINGTON (CN) &#8211; Supreme Court justices seemed split on Wednesday as to whether an Arizona law allowing the state to revoke the business licenses of employers who hire illegal immigrants is preempted by the federal comprehensive immigration scheme for employing illegal immigrants.</p>
<p>     &#8220;How can you reconcile [congressional] intent to prevent discrimination against people because of their appearance or accent? How do you reconcile that with Arizona&#8217;s law?&#8221; Justice Stephen Breyer asked Arizona Solicitor General Mary O&#8217;Grady, arguing for the state.</p>
<p>     A group of business owners, civil rights lawyers and immigrants&#8217; advocacy groups claimed that the Arizona law is unconstitutional, but their claims were struck down in district court, which ruled that the Arizona could use state licensing laws to enforce the federal Immigration Reform and Control Act, under the savings clause. The 9th Circuit affirmed.</p>
<p>     O&#8217;Grady said Arizona&#8217;s law was a &#8220;natural consequence of the savings clause,&#8221; which reserves states&#8217; rights to regulate employment through licensing.</p>
<p>     The parties and justices differed on the definition of licensing laws.</p>
<p>     Justice Antonin Scalia sympathized with the state, saying state licensing laws were the &#8220;only option&#8221; left to the states for enforcing federal immigration laws because the government expressly forbade states from imposing fines on businesses that hired illegal immigrants.</p>

			<content:encoded><![CDATA[<p>Oakland is poised to join a handful of cities in creating a municipal identification card that is touted primarily as a way for illegal immigrants to prove their identity.</p>
<p>But unlike programs in other locales, Oakland&#8217;s plan will be the first in the nation to create an alternative banking system for the poor, with the ID doubling as a full-service debit card.</p>
<p>Card holders will be able to load money onto their cards, freeing them from the vulnerability of walking around with cash or relying on costly check-cashing outlets.</p>
<p>&#8220;This will probably be the most advanced municipal ID in the country,&#8221; said Councilwoman and Mayor-elect Jean Quan, who has driven the effort alongside Councilman Ignacio De La Fuente.</p>

			<content:encoded><![CDATA[<p>WASHINGTON &#8211; Senate Majority Leader Harry Reid, who was re-elected last week with strong support from Hispanic voters, will make one last push in the final days of the 111th Congress to pass legislation allowing illegal immigrants who were brought to the United States as children to earn legal status if they attend college or serve in the U.S. military.</p>
<p><img alt="" src="http://t0.gstatic.com/images?q=tbn:ANd9GcTh9LM-lHmnKQJrEoXm27p7uGqBuGSSP7XvOycxaA6P19BcK26jlg" class="alignright" width="260" height="176" />Advocates of the Development, Relief and Education for Alien Minors Act &#8211; better known as the DREAM Act &#8211; say Reid has a better chance of passing the bill in the &#8220;lame duck&#8221; session than he would when the new, divided Congress is sworn in this January.</p>
<p>Reid and other Democrats owe a political debt to Hispanic voters, who helped the party keep control of the Senate. Their support helped embattled Democrats in California, Colorado and Washington retain their Senate seats. Reid, for example, won 68 percent of the Hispanic votes in Nevada, while 30 pe rcent supported his challenger, Republican Sharron Angle, according to CNN exit polls. Angle won among white voters by 53 to 41 percent, the same polls show.</p>
